1. Overview
These Terms and Conditions of Sale and Use apply to any order placed on the musique-shop.fr website, operated by Musique Shop SAS.
In these terms, the words “we”, “our” and “us” refer to Musique Shop. The words “customer”, “you” or “user” refer to any person browsing the website or placing an order on it.
The website enables the online sale of musical instruments, accessories, audio equipment, sound reinforcement equipment, products related to musical practice and associated services.
Any order placed on the website implies full and unconditional acceptance of these Terms and Conditions of Sale and Use.

3. Access to the website and customer account
The website is accessible to any user with Internet access. Any costs related to accessing the website, including connection, hardware or software costs, remain the responsibility of the user.
Certain features, including order tracking, return requests or access to purchase history, may require the creation or use of a customer account.
The customer undertakes to provide accurate, complete and up-to-date information when creating an account or placing an order.
The customer is responsible for maintaining the confidentiality of their login details and for any activity carried out through their account.
4. Products
Musique Shop offers musical instruments, accessories, audio equipment, stage equipment, studio equipment and related products for sale.
We take great care in presenting products, including descriptions, specifications, photos, prices and availability.
However, photographs, visuals, colours or renderings displayed on the website may vary depending on the screen, device settings or information provided by manufacturers.
Technical specifications, descriptions and availability may be changed at any time, particularly in the event of updates to supplier or manufacturer information.
5. Product availability
Products are offered subject to available stock.
If a product becomes unavailable after the order has been confirmed, Musique Shop will inform the customer as soon as possible. Depending on the situation, the customer may be offered:
- a restocking delay;
- an equivalent product;
- a full or partial refund of the order;
- a store credit, only with the customer’s agreement where required by law.
The customer may choose to wait for restocking or request cancellation of the order concerned when the product is not available within a reasonable time.
6. Order
The customer may place an order directly on the website by adding the desired products to the basket and following the order validation steps.
Before final validation, the customer can check the details of the order, the total price, any fees, the delivery information and correct any errors.
The order is considered confirmed after payment has been validated and an order confirmation email has been sent.
Musique Shop reserves the right to refuse or cancel any order for a legitimate reason, including suspected fraud, ongoing dispute, obvious pricing error, product unavailability or payment-related difficulty.
7. Prices
Prices displayed on the website are shown in the currency applicable to the country or market concerned.
For customers located in France or in the European Union, prices are shown including all applicable taxes, unless otherwise stated.
For customers located outside the European Union, including the United Kingdom, prices, taxes, customs duties or applicable fees may vary according to the rules of the relevant market and the settings displayed when placing the order.
For the United Kingdom, prices may be displayed in pounds sterling (£). Where indicated on the product page and at checkout, taxes and customs duties are included.
The total price payable by the customer is shown before the order is confirmed. It includes the price of the products, applicable taxes and delivery costs where charged.
Musique Shop reserves the right to change its prices at any time. The applicable price is the one displayed at the time the order is confirmed, subject to obvious error.
8. Payment
Payment is made online using the payment methods offered on the website at the time of ordering.
The available payment methods may include, depending on availability:
- bank card;
- Shopify Payments;
- PayPal;
- Klarna;
- any other payment method enabled on the website.
Payment is secured by our payment providers. Musique Shop does not directly store the customer’s full bank card details.
The order will only be processed after effective validation of the payment.
9. Invoicing
An invoice may be made available to the customer after the order has been confirmed.
The customer undertakes to provide accurate and complete billing information.
For professional customers, it is the customer’s responsibility to provide the information necessary for the correct preparation of the invoice, including company name, address, intra-community VAT number where applicable and any useful information.
10. Delivery
Products are delivered to the address provided by the customer when placing the order.
The customer is responsible for the accuracy of the delivery information provided. In the event of an incorrect, incomplete or inaccessible address, or repeated absence, any return, handling or reshipping costs charged by the carrier may be borne by the customer.
The delivery times indicated on the website are provided as estimates, unless a specific commitment is expressly stated before the order is placed.
Musique Shop cannot be held liable for delays caused by force majeure, carrier disruption, customs checks, an incorrect address or any event beyond its control.
In the event of a significant delay or delivery difficulty, the customer may contact customer service so that a solution can be sought.
11. Transfer of risk
For consumer customers, the risk of loss or damage to the product is transferred to the customer when the customer, or a third party designated by the customer, takes physical possession of the product.
If the customer chooses a carrier that is not offered by Musique Shop, the transfer of risk may take place when the product is handed over to the carrier chosen by the customer.
12. Receipt of the order
The customer is invited to check the condition of the parcel and products upon receipt.
In the event of a damaged parcel, broken product, missing item or reference error, the customer must contact customer service promptly with:
- the order number;
- a description of the issue;
- photos of the product;
- photos of the outer and inner packaging;
- a photo of the carrier label where necessary.
These elements are essential to allow the case to be analysed and, where appropriate, to open a claim with the carrier or supplier concerned.
13. Statutory right of withdrawal
In accordance with the regulations applicable to distance selling, consumer customers have a statutory period of 14 days from receipt of the order to exercise their right of withdrawal, except for exceptions provided by law.
To exercise this right, the customer must inform Musique Shop of their decision to withdraw before the expiry of the statutory period.
The customer may submit the request via their customer account, through the live chat available on the website or by email at: contact@musique-shop.fr.
After notifying withdrawal, the customer must return the product within the applicable legal time limits and according to the instructions provided by customer service.
Return shipping costs are borne by the customer in the event of withdrawal, unless otherwise stated or in the event of an error attributable to Musique Shop.
14. Commercial return policy up to 30 days
In addition to the statutory 14-day right of withdrawal, Musique Shop offers a commercial extension allowing customers to request a return up to 30 days after receipt of the order.
Returns requested between the 15th and 30th day after receipt are subject to approval by our customer service team.
For these commercial returns, the refund may be issued as a store credit valid on a future order, unless otherwise agreed by our customer service team.
15. Return conditions
No product should be returned without a prior request and approval from customer service.
The return address is provided only after the request has been approved. Depending on the product concerned, the return may be directed to our logistics department, our after-sales service department or an authorised partner.
To be accepted, the returned product must be:
- complete;
- clean;
- undamaged;
- not used beyond a simple reasonable test;
- returned with its accessories, manuals, cables, protective elements and supplied items;
- returned in its original packaging where possible.
Any return sent without prior authorisation may be refused or may result in additional processing delays.

16. Products excluded or subject to specific conditions
Certain products cannot be returned or may be subject to specific conditions, including:
- personalised products or products specially ordered at the customer’s request;
- opened or used consumables, such as strings, reeds, drumsticks, drumheads or wear-and-tear accessories;
- software, licences or digital products once opened, activated or downloaded;
- incomplete, damaged or modified products, or products returned without essential accessories;
- gift cards.
If there is any doubt as to whether a product is eligible for return, the customer is invited to contact customer service before shipping anything back.
17. Refund
After receiving and inspecting the returned product, Musique Shop will inform the customer whether the refund has been accepted or refused.
If the refund is accepted under the statutory right of withdrawal, it will be made using the payment method used for the order.
The refund may be deferred until the returned product has been received or until the customer provides proof of shipment of the product, in accordance with the conditions provided for by applicable regulations.
The time required for the refund to appear may vary depending on the customer’s bank or payment provider.
18. Refused parcel or carrier return
In the event of a parcel being refused by the customer, an incorrect address, repeated absence or failure to collect the parcel from a pickup point or carrier, any return, handling or reshipping costs charged by the carrier may be deducted from the refund.
A logistics handling fee of €45 may be applied where costs are incurred following a refused parcel or carrier return not attributable to Musique Shop.
19. Statutory warranties
Products sold by Musique Shop benefit from the applicable statutory warranties, including:
- the statutory warranty of conformity;
- the statutory warranty against hidden defects.
These warranties apply independently of any commercial warranty that may be offered by Musique Shop, the manufacturer or the supplier.
In the event of a defective or non-compliant product, the customer must contact customer service so that a solution can be sought in accordance with the applicable rights.
20. Commercial warranty and after-sales service
Some products may benefit from a manufacturer’s or supplier’s commercial warranty. The conditions, durations and procedures of these warranties may vary depending on the brands and products.
Musique Shop assists its customers with after-sales service requests where possible, but some interventions may be handled directly by the manufacturer, supplier or an authorised technical centre.
Any after-sales service request must be sent to customer service with the order number, a description of the issue and, where necessary, photos or videos showing the defect.
21. Retention of title
Products remain the property of Musique Shop until full payment of the price by the customer.
This clause does not prevent the transfer of risk to the customer under the conditions provided by law, in particular upon physical receipt of the product by the consumer customer.
22. Use of the website
The user undertakes to use the website lawfully, fairly and in accordance with these terms.
In particular, it is prohibited:
- to use the website for fraudulent or illegal purposes;
- to interfere with the operation, security or integrity of the website;
- to attempt to gain unauthorised access to Musique Shop accounts, data or systems;
- to publish or transmit unlawful, offensive, defamatory, misleading content or content infringing third-party rights;
- to use robots, scripts or automated tools likely to disrupt the operation of the website.
23. Intellectual property
All elements appearing on the website, including texts, images, graphics, logos, videos, product pages, editorial content, website structure and visual elements, are protected by intellectual property rights.
Any reproduction, representation, modification, distribution or exploitation, in whole or in part, without the prior written authorisation of Musique Shop is prohibited.
Trademarks, logos and content belonging to manufacturers, suppliers or partners remain the property of their respective owners.
24. Customer reviews, comments and submitted content
When the customer submits a review, comment, message, photo, experience feedback or any other content to Musique Shop, the customer guarantees that they have the necessary rights to do so.
Musique Shop reserves the right to moderate, refuse or delete any content that is manifestly unlawful, abusive, defamatory, fraudulent, misleading or contrary to third-party rights.
Customer reviews may be published on the website or on media associated with Musique Shop, in compliance with applicable regulations.

Personal data collected in connection with the use of the website or the placing of an order is processed in accordance with our privacy policy.

Sales made on the website are concluded directly between the customer and Musique Shop. Shopify is not the seller of the products offered on the website.
Certain data may be processed by Shopify as part of the provision of the e-commerce platform, in accordance with its own privacy policy.
28. Errors, inaccuracies and omissions
Some information on the website may occasionally contain errors, inaccuracies or omissions, particularly concerning descriptions, prices, promotions, delivery times, availability or technical specifications.
Musique Shop reserves the right to correct any error, inaccuracy or omission, modify the information displayed or cancel an order in the event of an obvious error, particularly in the case of an obviously incorrect price.
If an order is cancelled for this reason, the customer will be informed and refunded any sums paid.
29. Liability
Musique Shop makes every effort to ensure the accessibility, security and proper functioning of the website.
However, Musique Shop cannot guarantee that the website will be accessible without interruption, error or technical incident.
Musique Shop cannot be held liable for indirect damages, business losses, data losses or prejudice resulting from abnormal use of the website, force majeure, an act attributable to the customer or an act attributable to a third party.
No clause in these terms may have the effect of depriving a consumer customer of the statutory rights they benefit from under applicable regulations.
30. Force majeure
Musique Shop cannot be held liable in the event of non-performance or delayed performance of its obligations resulting from an event of force majeure within the meaning of applicable regulations.
Depending on the circumstances, force majeure events may include strikes, natural disasters, fires, weather events, transport blockages, network interruptions, administrative decisions, pandemics, supplier shortages or events beyond our control.
31. Consumer mediation
In the event of a dispute, the customer is invited to contact Musique Shop’s customer service first in order to seek an amicable solution.
In accordance with the provisions of the French Consumer Code, consumer customers may use a consumer mediator free of charge in the event of an unresolved dispute with Musique Shop.

32. Applicable law
These Terms and Conditions of Sale and Use are governed by French law.
In the event of a dispute, the parties shall first seek an amicable solution.
Failing amicable resolution, the dispute shall be brought before the competent courts under the conditions provided for by the applicable regulations.
For consumer customers residing in another country, the mandatory provisions of local consumer law may also apply where provided by law.
33. Changes to these terms
Musique Shop reserves the right to modify these Terms and Conditions of Sale and Use at any time.
The applicable terms are those in force at the time the order is placed.
